The Federal Government has closed its case against Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), after calling its fifth and final witness in the terrorism charges filed against him.
Kanu is standing trial on an eight-count charge bordering on terrorism before the Federal High Court in Abuja.
The prosecution’s final witness, identified as Mr EEE, a Department of State Services (DSS) officer based in Abuja, told the court he only knew Kanu through the media and had never interacted with him personally. He revealed that he led a team to the southern part of the country to gather intelligence on events linked to the 2020–2021 EndSARS protests.
According to the DSS officer, their findings showed that 128 police officers, 37 military personnel, and 10 DSS operatives were killed during the protests. He also reported that 164 police stations and 19 Independent National Electoral Commission (INEC) facilities were destroyed.
However, during cross-examination, the witness admitted he was not involved in investigating the specific crimes Kanu is accused of. He also said he was unaware of any connection between IPOB and violent incidents in Lagos, Ibadan, or Ile-Ife, and had no knowledge of the Lagos State judicial panel report, which did not indict IPOB over the EndSARS protests.
Following the cross-examination, the prosecution announced it had concluded its case, stating that the evidence and testimonies presented were sufficient to establish its claims.
In response, Kanu’s lead counsel, Kanu Agabi (SAN), informed the court of the defence team’s plan to file a no-case submission and requested 14 days from June 24 to do so. Justice James Omotosho granted the request and also gave the prosecution an additional 14 days to respond.
The case was adjourned until July 18, 2025, for the adoption of written addresses on the no-case submission.
